DWI, DUI and Impaired Driving
Our job is to do all we can to help the judge find you not guilty. In Wake County, you have two options when it comes to a DWI. Either you plead not guilty, and have a trial, or you plead guilty. At trial, the judge will consider four things before making a decision:
- The quality of your driving
- What you told the officer
- How you performed on the coordination tests
- What you blew on the Breathalyzer at the police station
The prosecutor must prove that the arresting officer had "reasonable suspicion" to stop you, "probable cause" to arrest you and proof of driving while impaired "beyond a reasonable doubt" to convict you. The prosecutor also must prove that the officer followed several statutory and constitutional procedures before the judge may find you guilty. Each of these issues is an opportunity for the officer to make a mistake and for us to win at trial.
