Social Security Application Process

It is very important to hire an experienced Social Security Disability Lawyer because the Social Security Disability Application process is very difficult and it may take years to get approved.

Many people believe they will receive benefits shortly after applying, but most people have to wait on average about two years before they are awarded benefits.

Attorney Erika Jones knows what to send the Social Security Administration to improve your chances of getting approved.  The Social Security Administration uses certain factors to decide whether to approve your claim, but they mostly rely on the information you give them.  It is their job to collect information about you, but they can only collect that information based on what you tell them.

Applications are more likely to be approved if they are complete and contain the right information.   Attorney Erika Jones knows what the Social Security Administration is looking for and what to send them.  She will also work closely with your case manager to keep them updated on new developments with your condition and ensure they are collecting all of your medical records.

There are several levels of the application process.  The first step is to file an initial application.  If you think you are eligible, you should file an initial application immediately because it may take up to four months before you get a decision, and most people are denied initially.  Our office can help you file your application effectively to increase your chances of being approved.

If your initial application is denied, you only have sixty days to appeal that decision.  This appeal is known as a Request for Reconsideration.  On average, this appeal will also take about four months before you get a decision.  It is very important to get the help of a skilled attorney to file your Request for Reconsideration because if you are denied again, the next step is to go to hearing before an Administrative Law Judge.

If your Request for Reconsideration is denied, you can request a hearing before an Administrative Law Judge.  Most people have to wait about a year and a half before it is their turn to have a hearing.  It is very important to have a skilled attorney represent you at your hearing.  The Judge will question you about your condition, so you will want your attorney there to guide you through that process and be able to also ask you questions that will help your case.

It can take up to four months before the Administrative Law Judge issues a decision on your case.  If the Judge denies your claim, then you have sixty days to appeal that decision to the Appeal’s Council.  The Appeals Council may take up to one year to decide whether they agree with the Judge or not.

If the Appeals Council denies your claim, the only option left other than reapplying, is to take your case to federal court.  Attorney Erika Jones is very skilled at appealing Social Security cases in federal court.  She is referred these types of cases from other Social Security lawyers all over the state, so if your case is a good case for federal court, she can take it no matter where you live.
